CAMBRIDGE PLASTERING – TERMS AND CONDITIONS OF TRADE

Scott Saunders | 022 024 5404 | scott@cambridgeplastering.co.nz | www.cambridgeplastering.co.nz

1. Application of These Terms

These Terms and Conditions apply to all plastering and related services provided by Cambridge Plastering, operated by Scott Saunders ("we", "us", "our"), to any person or entity engaging our services ("Client", "you"). By requesting, accepting, or paying for any of our services, you agree to be bound by these Terms.

2. Quotes and Estimates

All quotes are valid for 7 days from the date of issue unless otherwise stated. After this period, we reserve the right to revise pricing due to changes in material costs or availability.

Quotes are based on information available at the time of inspection. If additional work is identified once work has commenced — such as hidden damage, substrate issues, or conditions not visible at the time of quoting — we will notify you and provide a revised quote before proceeding.

Unless specifically listed, quotes do not include removal or disposal of asbestos or other hazardous materials, structural repairs or building remediation, council consents, permits, or engineer reports, or remediation of pre-existing water damage, rising damp, or rot.

3. Accepting a Quote

A quote is accepted when you provide written or verbal confirmation, or allow work to commence on-site. Acceptance constitutes your full agreement to these Terms. Any changes to the agreed scope of work must be confirmed in writing (including by email or text). We are not obligated to carry out work outside the original scope without issuing a formal variation.

4. Pricing and Payment

All prices are in New Zealand Dollars (NZD) and include GST unless otherwise stated. Cambridge Plastering is a GST-registered business.

An invoice will be issued upon completion of the work. Payment is due in full on the date of invoice. We accept payment by bank transfer or cash. Bank account details are provided on the invoice.

Invoices not paid by the due date may incur a late payment fee of 2% per month on the outstanding balance. We reserve the right to pursue recovery of overdue amounts, including any reasonable costs of collection.

5. Variations to Scope

Where additional work is required beyond the original quote, we will provide a variation quote in writing. This must be approved by you before the additional work is carried out. Variation costs are added to the final invoice under the same payment terms.

6. Your Responsibilities

To enable us to carry out work efficiently and safely, you agree to provide safe and unobstructed access to all areas where work is to be carried out, ensure the work area is clear of furniture, valuables, and personal items before we arrive, provide access to water and electricity as reasonably required, notify us of any known hazardous materials on-site (including asbestos or lead paint) before work begins, keep pets and children away from the work area during and immediately after completion, and obtain any council consents or permits required for the work.

Any additional costs or delays caused by failure to meet these responsibilities will be charged accordingly.

7. Health and Safety

Cambridge Plastering operates in accordance with the Health and Safety at Work Act 2015 and is committed to a safe work environment for all parties. You must disclose any known site hazards before work begins. We reserve the right to stop work immediately if an undisclosed hazard is discovered, and any costs associated with the resulting delay will be charged to you.

8. Workmanship Guarantee

If you are not satisfied with any aspect of the completed work, please notify us in writing within 7 days of completion. We will inspect the work and, where a defect is confirmed to be due to our workmanship, rectify it at no additional cost. This guarantee does not cover damage from building movement or settlement, moisture or water ingress not disclosed prior to work, cracking from normal building movement, defects caused by other trades after our completion, or cosmetic concerns raised after the 7-day period.

9. Cancellation

If you need to cancel or postpone a confirmed booking, please notify us as soon as possible. Cancellations made less than 48 hours before the scheduled start date may incur a fee to cover lost time and materials already purchased. If we are unable to complete a job due to circumstances outside our control, we will reschedule at the earliest available time at no additional cost to you.

10. Limitation of Liability

Cambridge Plastering's total liability for any loss or damage is limited to the total amount paid for the services giving rise to the claim. We are not liable for indirect or consequential loss except where caused by our proven negligence. Nothing in these Terms limits any rights you may have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.

11. Dispute Resolution

If a dispute arises, both parties agree to first attempt resolution by direct, good-faith communication. If unresolved, either party may refer the matter to the New Zealand Disputes Tribunal or an agreed mediator.

12. Privacy

We collect personal information for the purpose of providing our services and managing our business. We will not share your information with third parties except as required to deliver our services or as required by law, and handle all information in accordance with the Privacy Act 2020.

13. General

These Terms are governed by the laws of New Zealand. If any provision is found to be invalid, the remaining provisions continue in full force. We reserve the right to update these Terms from time to time — the version in force when a quote is accepted applies to that job.
